This is an Article 19 appeal filed by the NALC protesting proposed changes to
Section 546 of the Employee and Labor Relations Manual (ELM)

Did the Employer violate Article 41 of the National Agreement when it refused to
honor the OPT of Emma Hudson on Route 211 at the Long Beach Downtown Station on
or about 1/19/99? If so, what is the appropriate remedy?
Did management violate Articles 3, 5, 8.5 and 10 of the National Agreement, the
Letter Carrier Paragraph, and Pacific Area MOU on Daily Overtime Violations
(04/14/2003) when they unilaterally changed practices and established a policy
that required non-ODL regulars to continually and repeatedly work mandatory
overtime when assistance was otherwise available, and if so, what is the
appropriate remedy?
National Decisions
Did the Employer violate the parties' agreement when transitional employes in
the NALC bargaining unit worked more than 12 hours? If so, what is the
appropriate remedy?
Did the Employer violate the parties' National Agreement by failing to use NALC
Transitional Employees for auxiliary assistance? If so, what is an appropriate
remedy?
Does the Joint Statement on Violence and Behavior in the Workplace constitute an
enforceable agreement between the parties so that the Union may use the
negotiated grievance procedure to resolve disputes rising under the Joint
Statement? If so, what is an appropriate remedy?
Did the Employer violate the parties' agreement by assigning the grievant to the
Clerk Craft as a part-time flexible employee rather than as a full-time regular
employee? If so, what is an appropriate remedy?
Did the Employer violate the parties' National Agreement , specifically Article
41 , Section 3, Paragraph 0, when full -time duty assignments were abolished due
to route adjustments and subsequent bidding was restricted to individual
stations / branches , as opposed to being done on an installation - wide basis?
If so, what is an appropriate remedy?
Does the reinstatement of an employee pursuant to a Dispute Resolution Team
decision resolving a grievance over that employee's removal under Article 16,
Section 5 automatically entitle that employee to back pay under Article 16,
Section 6, Paragraph C?
Whether management has the right to inspect city delivery routes on all six (6)
days and, if so, does management have the right to count the mail and make all
applicable entries on PS Form 1838C each day of the inspection?
Did the Postal Service violate any controlling authority by converting certain
deliveries in Cary, North Carolina and Placerville, California from city to
rural? If so, what shall the remedy be?
Did the Postal Service violate the National Agreement when on December 22 and
23, 2004 , it had PTFs on hold downs begin their tour two hours later, in order
to utilize office under time and at the same time have nonscheduled full-time
Carriers working overtime? If so, what shall be the remedy?
Did the Employer violate Article 5 (Prohibition of Unilateral Action) and past
practice when it mandated that all pictures and calendars be removed from the
carrier cases at Northaven Station? If so, what is the remedy?
Did the Postal Service violate National Agreement Article 15 by continuing to
fail to abide by the 2001 Levak arbitration award, three pre-arbitration
settlements and two Step B DRT decisions concerning the Up-Valley Run?
Were casual carriers in the Youngstown facility hired in accordance with Article
7 of the National Agreement and relevant National level arbitration awards? If
not, what shall the remedy be?
Failure to process CA-1 02695 - Did the Postal Service violate the National
Agreement by refusing to pay the grievant 11 .62 hours of COP?
Did the employer violate the Joint Statement on Violence and Behavior in the
Workplace through the behavior of Postal Inspector Bidwell on
November 3, 1994 , when he confronted carrier Mary Sudac and 1 ) repeatedly and
angrily pointed his finger in her face and 2) repeatedly yelled at her? If so,
what is the appropriate remedy?
